Nature of Services
The Mind & Company is a psychological wellness platform that delivers emotional
wellness
products and services to individuals and organisations. These include, but are not
restricted
to:
Face-to-face consultations with qualified mental health professionals (authorized by
The Mind & Company to deliver their services), offered in one-to-one or group
formats, within India.
Online consultations with users based in India or outside India, conducted by
authorized mental health professionals through secure video, audio, or chat-based
sessions.
Periodic self-assessments and psychological tests to support progress tracking,
early identification of concerns, and reflective practice.
Workshops and webinars facilitated by trained mental health professionals,
covering areas such as stress management, resilience building, and workplace
well-being.
Self-help tools, content, and structured programmes are offered across channels,
including, but not limited to, websites, mobile applications, and emails.
Confidential communication tools that allow clients to exchange private, encrypted
messages with their professionals, in addition to scheduled consultations.
Corporate wellness programmes are designed for organizations, including employee
assistance services, workplace mental health initiatives, and stress management
programmes.
Community support initiatives, including user forums, group discussions, peer
networks, and awareness programmes that encourage shared learning and reduce
stigma.
The services offered by The Mind & Company are in compliance with our client
anonymity
and confidentiality policies applicable in India (refer to our Privacy Policy).
The Mind & Company reserves the right to add, modify, or remove products and
services
from its offerings without prior notification.
Critical Disclaimers
Emergency Services Disclaimer: The Mind & Company does not provide emergency
mental health services and is not designed to offer support in crisis situations.
This
includes instances of self-harm or suicidal thoughts, immediate danger to self or
others, severe clinical disorders requiring urgent medical attention, psychotic
episodes, or any acute mental health emergency.
Emergency Contact Information: If you are facing a mental health emergency,
please contact emergency services at 100, 102, or 108, the National Suicide
Prevention Helpline (Aasra) at 91-22-27546669, or visit the nearest hospital
emergency room. You may also reach out to local police or emergency medical
services. In such situations, in-person intervention is the most appropriate, and we
recommend involving a trusted family member or friend for immediate support.
Geographic and Legal Limitations: Our services are primarily intended for users in
India and are governed by Indian laws and regulations. Users accessing services
from other regions do so at their own risk and must comply with the laws of their
respective jurisdictions.
User Agreement and Acceptance
Acceptance of Terms: By choosing to visit and/or avail any services, products, or
resources from The Mind & Company, you confirm that:
For Adults (18+ years): You are above 18 years of age, are not otherwise
incompetent to contract under the Indian Contract Act, 1872, and are legally
allowed to make decisions independently.
For Minors (Under 18 years): Your parent/guardian provides informed
consent for you to receive mental health services and agrees to abide by all
policies mentioned herein.
Legal Capacity: You have the legal capacity to enter into this agreement and
understand the implications of using our Services.
Agreement Formation: The user, or parent/guardian (as applicable), accepts and
agrees to these Terms and Conditions (the "User Agreement") and any additional
terms, conditions, and policies referenced herein. Please read this User Agreement
carefully, as the terms become effective upon your use of or access to our Services,
resources, or products from the Platform.
Modifications to Agreement: We reserve the right to add, modify, or remove
sections from this User Agreement at any point during the course of the agreement
without prior notice. Continuing to use The Mind & Company platform, or purchasing
any service, resource, or product, forms an obligatory legal agreement between you
and The Mind & Company. The liability to review this User Agreement from time to
time lies with you, the user. Continuation of use of the platform after revision of

User Agreement will be deemed acceptance of the revised terms.
Professional Service Understanding: By using our Services, you understand and

remotely and may not be in your immediate geographic area

All experts are fully qualified and licensed to practice in India

Our services are intended as support and therapy, not as emergency medical

The therapeutic relationship is established between you and the expert, with
The Mind & Company serving as a technology platform facilitator
Applicability of Terms
The general terms and conditions in this User Agreement are applicable to all
present and
future contracts established between the user and The Mind & Company.
This User Agreement applies to all users of the platform, including, without
limitation,
users who are browsers, vendors, customers, merchants, and contributors of content.
By availing any of our Services, the user irrevocably accepts all obligations
stipulated in this
User Agreement, the Terms of Use, the Privacy Policy, and other policies referenced
herein,
and agrees to abide by them. This User Agreement supersedes any previous oral or
written
terms and conditions that may have been communicated to the user.
Eligibility and User Requirements
Age and Capacity Requirements: Use of the Website is available to:

and your assigned expert. The Mind & Company serves as a technology platform
facilitator and is not directly involved in the therapeutic process. We cannot
guarantee:

Session frequency or scheduling preferences

Expert Assignment and Changes

Expert assignment is based on availability, specialization, and compatibility

Payment Terms and Billing
Service Charges: We charge for various Services, including:

Before availing any service, we will communicate the applicable charges. You agree

Payment Processing Disclaimer: You agree and accept that payment processing

referenced policies, constitutes the entire agreement between you and The Mind &
Company, superseding all prior agreements, communications, and proposals.
Severability: If any provision of these Terms is deemed illegal, invalid, or
unenforceable, such provision shall be modified or deleted to render the Terms legal
and enforceable to the maximum extent permitted. The remaining provisions shall
continue in full force and effect.
No Waiver: Our failure to exercise any right or enforce any provision shall not

amended through written mutual agreement.
Survival of Terms: Provisions that by their nature should survive termination
(including payment obligations, intellectual property rights, and limitation of

this Agreement without restriction.
